Job Description

(Internal Title: Contract Administration and Procurement V)

  • Direct and lead GO Expansion throughout the lifecycle of all contracts/projects, and ensure that there are effective and efficient commercial policies, procedures, and best practices in place to establish and maintain that function

  • Provide guidance and leadership in the development of procurement documents and contracting structures and oversee and develop strategies for contract negotiations and governance to ensure that the client effectively negotiates contracts that adhere to policies and procedures, and to minimize corporate liability and risk throughout the contract lifecycle

  • Lead the development and implementation of appropriate commercial management plans and strategies to maximize funding opportunities and related value, while minimizing risk to the client

  • Lead a commercial team and interface with technical team members and other stakeholders for the development and successful implementation of commercial strategies

  • Identify emerging commercial hot topics, issues, and risks, report contractual claims, and lead the management and resolution of legal and/or commercial disputes

  • Responsible for the development and implementation of comprehensive strategies, methodologies, tools and techniques for commercial management excellence, lessons learned and continuous improvement

  • Undertake commercial activities as required to support the GO Expansion program with respect to commercial management of advanced works, target price, actual costs management, and mobilization and integration. Set up and manage target cost contracts

  • Undertake an assessment of the development phase and early works, and recommend appropriate changes to processes and resources with the aim of controlling costs and delivering value for money

  • Together with the Development Phase Lead and, with assigned individuals, undertake an assessment of spend to date and review the outturn of the development phase, and implement controls to provide certainty of cost

  • Assess the status of the current cost plans and implement changes to provide a more robust cost plan that provides a clear understanding of the total cost. This will be a progressive refinement and will be done with the contractor and utilization of internal information

  • Initiate dialogue to create a collaborative, transparent and constructive relationship with the contractors to enable a more mutually beneficial environment with aims to challenge target cost for the contractor and drive value for money for the client

  • Review existing processes and procedures and assess their viability to provide controls and information during the life of the target cost implementation period. This includes taking a lifecycle view of the target price process, identifying gaps, and providing ideas and documentation to ensure a robust end-to-end process

  • Building capability by sharing skills, knowledge and experience, and embedding within the tools developed to leave a legacy of best practice, including process documents, guidance material, and outputs from lessons learned exercises

  • Lead the resolution of issues of corporate significance, as required to recover or protect commercial reputation, and ensure value for money and sound commercial decision-making

  • Oversee commercial management services in areas of contract administration, procurement services, and claims management ensuring the work is fully supported in an integrated, compliant, efficient, and cost-effective manner from inception through to completion

  • Organize commercial services activities per the mission and goals of the contract, project, or program. This includes all services related to commercially supported claims management services

  • Create and manage short and long-term commercial management services goals and success criteria for contracts, projects, or programs

  • Draft an operating and delivery plan along with a budget for the required commercial services, in consultation with the applicable stakeholders

  • Exercise authority in managing the work and controlling the delivery of the services under the contract or project portfolio

  • Manage a team in the area of commercial management or combined services (may consist of multi-firm and client resources) by leveraging a diverse array of talents and delegation of responsibilities

  • Direct and supervise team dynamics and performance-related issues including the review and approval of timesheets, vacation requests, employee evaluations, employee engagements, etc.

  • Liaise with the applicable representatives on team performance, overall deliverable issues, and commercial strategies and benefits

  • Outline the human and material resources required to complete assigned contracts and projects successfully

  • Formulate a resource allocation strategy and utilize this to distribute work and budgets

  • Identify risks, implement mitigation strategies and contingency plans, and negotiate scope changes including the development of costs and risk assessments for review with company leadership and develop change requests under the contracts with the client

  • Track, monitor, and report performance against commercial requirements, contractual deliverables, schedules, milestones, budgets, quality measures, and KPIs, and address issues with corrective actions as appropriate

  • Evaluate commercial performance and effectiveness by consulting with clients and project staff on acceptable standards of workmanship at every stage of the work

  • Develop and deliver progress reports, proposals, evaluations, and presentations to various audiences, including the project team, senior executives, and key stakeholders

  • Engage in ongoing quality control, clarify internal quality control checks, and participate in issue resolution for the project

  • Build and maintain a positive, high-performing team culture with an openness to constructive challenge, continuous improvement, implementation of lessons learned, and an overall ‘right-first-time” mindset

  • Monitor and manage commercial staff, focused on project performance objectives (including non-company resources) in areas of commercial management, claims management, contract administration, and procurement to ensure excellence in results and adherence to specified deadlines, the overall scope, schedule, and budget

  • Promote an environment that is inclusive, and diverse and celebrates our differences

  • Provide training to other members of the project team, appropriate to their area of accountability

  • Define the success criteria and disseminate them to involved parties throughout the contract, project, and program life cycle

  • Recommend and interpret project and program expectations while delegating and managing deliverables with team members and stakeholders

Qualifications

Experience:

  • Minimum of 18 years of experience in Project Management

Education:

  • Bachelor’s degree in relevant field of Construction, Engineering, Project Management, Business Administration, Finance, Logistics or Supply Management

  • Licenses OR Certifications:

  • Holding recognized certification in specified fields of Engineering, Contracts Management, Program Management, Procurement Management, or Project Management including PMP (Project Management Professional), Professional Engineers of Ontario (PEO), Certified Professional Contracts Manager (CPCM), Chartered Institute of Purchasing and Supply (CIPS), Certified Supply Chain Professional (CSCP), Certificate Professional in Supply Chain Management (CPSM) or equivalent

Skills and Competencies:

  • Demonstrated experience in a public transportation development, construction environment with experience and measured success in the application of commercial management methodology in the context of major, complex infrastructure projects; construction experience in the transportation industry and/or public sector is an asset

  • Experience having developed / structured, procured, negotiated and/or administered complex contracts is required

  • Knowledge of regulatory, legislation, building codes, legal, and financial issues and government bodies, external agencies, and partnering transit organizations involved in developing public transportation systems, knowledge of construction engineering principles and best practices

  • Detailed understanding of different procurement strategies and project delivery models (traditional, NEC, Alliance, P3, and collaborative) and the associated benefits and risk transfer implications

  • International Transit experience and particularly UK transit experience is preferred, including expert knowledge of transit-related risks across construction, design, engineering, and/or commercial management

  • Knowledge of relevant legislation, policies, procedures, professional or technical practices, and precedents (e.g., Places to Grow Act, Planning Act)

  • Adept in Project Management methods

  • Mastery of tools and metrics needed to evaluate project performance

  • Proficient in Project Management software

  • Advanced skills in Microsoft Office

  • Ability to work creatively and analytically in a problem-solving environment by ensuring effective teamwork, promotion of innovation, and overall excellence

  • Proven ability to anticipate, identify, and minimize risks

  • Expert ability to detect, capitalize, and be sensitive to others' strengths

  • Demonstrated capability to lead large contracts and commercial teams, supervise, delegate, and develop capacity

  • Ability to perceive and ameliorate conflict and tension

  • Competent in understanding interdependencies between technology, operations, and business needs

  • Demonstrated functional acumen to support how solutions will address client goals while maintaining alignment with industry best practices

  • Proven success in providing on-site leadership to project teams through building and motivating staff to meet project goals, adhering to their responsibilities and project milestones

  • Must maintain professional development to keep abreast of emerging technologies, methods, and best practices

  • Demonstrated ability to negotiate the terms under contracts

  • Fosters collaborative relationships with various teams, partners, and clients

  • Ability to arrange priorities and escalate competing risks to meet deadlines with minimum input from leadership    

  • A keen eye for detail and adept problem-solving abilities with a track record for meeting deadlines 

  • Must have demonstrated experience relaying and receiving information (written and verbal) in a demanding multidisciplinary project environment 

  • Expert ability to work collaboratively and independently on creative and analytical tasks in a structured, disciplined, technology-driven environment
